Acceptance of Terms

By accepting a written quotation, submitting a project deposit, paying an invoice, or instructing Sydney Website Builder ("us", "we", "our") to commence work on a website, logo, or design project, you ("the Client") agree to be bound by these Terms and Conditions.

These Terms constitute a legally binding contract between Sydney Website Builder and the Client under the laws of New South Wales, Australia.

Services & Package Scopes

We deliver professional digital and design solutions structured under fixed transparent packages and bespoke quotes:

• Starter Website ($495): Focused single/multi-section small business page (scope up to 3 pages), mobile-responsive layout, standard contact form, basic Google SEO setup, and 1 included revision round.
• Business Website ($995): Comprehensive business website (4–8 pages), custom UI sections, lead capture forms, service showcases, Google Maps integration, speed optimization, and 2 included revision rounds.
• Growth Website ($1,995): Advanced multi-page business platform (9–20 pages), custom lead flows, detailed service architecture, advanced technical SEO, and 3 included revision rounds.
• E-Commerce Development (from $995): Online store development including product catalog setup, shopping cart, payment gateway integration (Stripe/PayPal), and checkout workflow.
• Logo & Graphic Design (from $49): Custom vector logo design, brand identity packages, and print-ready business card files.

Client Responsibilities & Content

To enable us to maintain fast delivery timelines, the Client agrees to provide all necessary project materials, including text copy, logo files, images, business details, and domain/hosting access within 7 days of project initiation.

Pricing, Deposits & Payment Terms

• Currency & GST: All prices quoted are in Australian Dollars (AUD). Tax invoices will be issued upon agreed project milestones.
• Payment Milestones: Standard website projects require a 50% upfront deposit prior to design commencement, with the remaining 50% balance due upon final project approval prior to site launch/handover. Starter logo & business card packages require 100% upfront payment.
• Payment Methods: Electronic Funds Transfer (EFT / Direct Deposit), Visa, Mastercard, or secure online invoice payment.
• Overdue Accounts: Invoices not paid within 14 days of due date may incur a late payment fee of 2.5% per month. Sydney Website Builder reserves the right to suspend active website development or withhold final source code until outstanding balances are cleared.

Revision Policy & Scope Changes

Each package includes a specified number of design revision rounds to refine layout, typography, colors, and content placement within the original agreed project scope.

Any requests for additional pages, custom features, third-party API integrations, or major structural redesigns outside the initial written project scope will be quoted separately as an add-on or billed at our standard developer rate of $95/hour + GST.

Intellectual Property & Ownership

Full Client Ownership: Upon receipt of full and final payment, complete intellectual property ownership of the custom website design, written content, vector logo artwork, and custom code files is transferred entirely to the Client. You retain 100% full ownership of your site.

Portfolio Display Right: Unless explicitly requested otherwise in writing prior to project kickoff, Sydney Website Builder reserves the right to display completed website screenshots, logos, and brief project descriptions in our online portfolio and promotional showcase.

Domain Names & Hosting Services

Domain name registration and web hosting accounts are registered under the Client’s name to ensure full client administrative control.

While we configure DNS records and server deployment settings, Sydney Website Builder is not liable for third-party hosting server downtime, hardware failures, domain renewal oversights by the Client, or third-party service outages beyond our reasonable control.

Warranties & Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL) in the Competition and Consumer Act 2010 (Cth).

Limitation of Liability

To the maximum extent permitted by Australian law, Sydney Website Builder shall not be liable for any indirect, incidental, special, or consequential loss or damage, including loss of profit, business revenue, data loss, or commercial reputation arising out of or in connection with our services.

Our total cumulative liability under any claim related to a project shall not exceed the total amount paid by the Client to Sydney Website Builder for that specific project.
